Distribution of Personal Information

In accordance with your right to opt-out, we may share, rent, or sell your personal information (Category A, F, and I) in the following ways: (a) to third-party service providers featuring their products and services in the ApplianceRepairToday™ Offerings, and (b) for other business objectives outlined previously.

Whenever we share personal information with third-party service providers or other entities, we establish a contractual agreement that specifies the use of the personal information. This contract mandates the confidentiality of the information and restricts its use solely to the services outlined in the agreement.

We do not gather information from California Users under eighteen (18) years of age and do not share or sell the personal information of such users. Specifically, in the last twelve (12) months, we have not shared or sold personal information of California Users we know to be under sixteen (16) years of age.

In the past year (12 months), we have disclosed the following categories of personal information for business purposes:

  • Category A: Identifiers.
  • Category E: Internet or other similar network activity.
  • Category H: Professional or employment-related information.

We disclose your personal information for business reasons to these categories of third parties (specified categories of personal information in brackets):

  • Our affiliates (Category A, E, H).
  • Service providers (Category A, E, H).
  • Third-party service providers offering products and services on the Site (Category A, E, H).

Opt-Out Right for Personal Information Sales

You are entitled to opt-out of the sale of your personal information to third parties. To exercise this right and submit a verifiable request as a California User, you can:

We aim to respond to all opt-out requests promptly, and guarantee a response within fifteen (15) days of receiving your request.

 

Right to Access Specific Information and Data Portability

You have the right to request disclosure of certain information regarding our collection and usage of your personal information in the last twelve (12) months. Upon receiving and verifying your request as a California User, we will provide you with:

  • The types of personal information we have collected about you.
  • The sources from which the personal information was collected.
  • Our business or commercial reasons for collecting or selling that personal information.
  • The categories of third parties with whom we have shared your personal information.
  • The specific personal information we have collected about you (also known as a data portability request).

Should there have been any sale or disclosure of your personal information for business purposes, we will provide two distinct lists detailing:

  • Sales, specifying the categories of personal information purchased by each category of recipient; and
  • Disclosures for business purposes, specifying the categories of personal information obtained by each category of recipient.

 

Right to Request Deletion of Personal Information

As a user, you are entitled to request the removal of any personal information that we have collected and retained from you, though this is subject to certain exceptions.

Upon receiving and validating your verifiable request as a California User, we are committed to deleting your personal information from our records, as well as directing our service providers to do the same, unless an exemption is applicable.

However, there are circumstances under which we might deny your request for deletion if keeping the information is essential for us or our service providers in order to:

  1. Fulfill a transaction for which the personal information was collected, deliver a product or service you requested, carry out actions that are reasonably expected as part of our ongoing business relationship, or fulfill our commitments under any contract with you.
  2. Detect and address security incidents, guard against harmful, deceitful, fraudulent, or illegal activities, or prosecute those accountable for such actions.
  3. Identify and rectify malfunctions in products that affect their intended functionality.
  4. Uphold the right to free speech, guarantee the free speech rights of other California Users, or exercise any other right provided by law.
  5. Adhere to the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
  6. Conduct public or peer-reviewed scientific, historical, or statistical research in the public interest, in line with all other relevant ethics and privacy laws, especially when erasing the information would likely make the research unfeasible or significantly hinder it, provided you have previously given informed consent.
  7. Facilitate purely internal uses that align reasonably with the expectations of California Users based on their relationship with us.
  8. Fulfill a legal obligation.
  9. Undertake other internal and lawful uses of the information that are consistent with the context in which you provided it.

 

Implementing Access, Data Portability, and Deletion Requests

To execute your rights to access, data portability, and deletion as outlined above, you can submit a verifiable request as a California User to us in one of two ways:

  • Emailing privacy@rbbrands.net, or
  • By sending a request via U.S. mail to: RB Brands LLC, 301 S McDowell St, Suite 125-1570, Charlotte, NC 28204.

Such requests can only be made by you or a person who is registered with the California Secretary of State and authorized to act on your behalf regarding your personal information.

You are limited to making a verifiable request for access or data portability no more than twice in a 12-month period. The request should:

  • Provide enough information for us to reasonably verify whether you are the person whose personal information we have collected or someone authorized to make the request on behalf of a California User.
  • Clearly describe your request so that we can understand, assess, and respond appropriately.

We are unable to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you.

Creating an account with us is not necessary to make a verifiable CA User request. Personal information provided in a verifiable request will solely be used to confirm the identity or authority of the person making the request.

 

Response Timing and Method

Our goal is to respond to all verifiable CA User requests within forty-five (45) days of receiving them. If we need more time (up to an additional forty-five (45) days), we will inform you in writing of the reason and extension period.

Our response will be sent to you either by mail or electronically, based on your preference. The information provided will only cover the 12-month period preceding the receipt of your verifiable request.

Our response will also include explanations for any non-compliance with a request, if applicable. For data portability requests, we will use a format that allows you to easily transmit the information from one entity to another without hindrance.

We do not charge a fee for processing or responding to your verifiable CA User request unless it is excessive, repetitive, or clearly unfounded. If we decide that a fee is applicable, we will explain why and provide a cost estimate before completing your request.

 

Non-Discrimination Policy

In exercising your CCPA rights, we will not discriminate against you. In accordance with CCPA, we will not:

  • Deny you goods or services;
  • Charge different prices or rates for goods or services, including offering discounts, other benefits, or imposing penalties;
  • Provide a different level or quality of goods or services; or
  • Suggest that you might receive a different price or rate for goods or services or a different level or quality of goods or services.

 

“Shine the Light” Law Disclosures

Under the California “Shine the Light” law, California residents have the right in certain situations to request information from us about how we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. To opt out of this type of sharing, please email us at privacy@rbbrands.net.

 

Nevada-Specific Disclosures

Nevada law grants residents the option to opt out of the sale of certain “covered information” collected by operators of websites or online services, even if their personal information is not currently being sold.

While we may share your data as outlined in our privacy policy, such as to improve your experiences and our services, these activities will not be affected by a Nevada do not sell request. Additionally, you may have other options regarding our data practices as detailed in this privacy policy.

 

Virginia-Specific Disclosures

Virginia residents have specific rights regarding their personal information. To exercise these rights, Virginia residents can use the following methods:
